By accessing and using the services provided by GK Host Point (including AquaHost and HostingMaster brands), you agree to comply with and be bound by the following terms and conditions. These terms govern your use of our web hosting, domain registration, VPS, dedicated servers, and all related services.
- Domain registrations are confirmed only after successful payment completion
- Accounts found in violation of these terms may be suspended or terminated without prior notice
- Users are solely responsible for securing their accounts, passwords, and data
- Failure to comply with these terms may result in immediate termination of services
- We reserve the right to refuse service to anyone at our sole discretion

Account Eligibility
To register and use our services, you must meet the following requirements:
- You must be at least 18 years of age or have parental/guardian consent
- Provide accurate, current, and complete information during registration
- Each user is permitted only one account per person/organization
- Maintain valid and up-to-date contact details (email, phone, address) for all communications
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized access or security breaches
- Be legally authorized to enter into binding contracts in your jurisdiction
Creating multiple accounts or providing false information may result in immediate account termination.

Billing & Payments
Our billing and payment terms are as follows:
- Prepaid Services: All hosting services must be paid in advance before activation
- Invoice Timing: Invoices are issued 7 days before the service due date
- Payment Methods: We accept UPI, credit/debit cards, net banking, and digital wallets (Indian payment methods only)
- Late Payments: Failure to pay by the due date will result in service suspension
- Service Termination: Accounts unpaid for 7+ days after due date will be permanently terminated
- No Refund After Termination: Once terminated for non-payment, no refunds will be issued
- Dispute Resolution: All payment disputes must be raised within 7 days and resolved directly with us
- Price Changes: We reserve the right to modify pricing with 30 days notice to existing customers

Refund Policy
We stand behind our services with a fair refund policy:
- 7-Day Full Refund: New hosting accounts can request a full refund (minus payment gateway fees) within 7 days of signup
- Pro-Rata Refunds: After 7 days, refunds are calculated on a pro-rata basis for the remaining service period
- Exclusions: Domain registrations, SSL certificates, and setup fees are non-refundable
- Abuse/Violation: No refunds for accounts terminated due to terms violations
- Refund Processing: Approved refunds are processed within 7-10 business days
- Request Method: All refund requests must be submitted through our support ticket system

Website Migrations
We offer complimentary website migration services under the following conditions:
- cPanel to cPanel: Free migrations for standard cPanel-based websites
- Other Platforms: Non-cPanel platforms (Plesk, DirectAdmin, custom) may not be supported for free migration
- Migration Guarantee: While we make every effort, migrations are provided on a best-effort basis and success is not guaranteed
- Backup Requirement: You must maintain complete backups before requesting migration - we are not responsible for data loss
- Eligibility: Free migrations are available only for new hosting accounts on annual plans
- Timeline: Migrations typically complete within 24-48 hours depending on website size
- Support: Technical assistance is provided only for standard cPanel migrations

Data Backups & User Responsibility
What We Provide
At GK Host Point (including AquaHost and HostingMaster), we understand the importance of data security. As a complimentary courtesy service, we provide:
- Daily Automated Backups: We perform automated daily backups of your hosting account using JetBackup technology
- 3-Day Retention: Backups are stored for up to 3 days, giving you recent restore points
- Easy Restoration: You can request backup restoration through your cPanel or by contacting our support team
- Best Effort Service: We make every reasonable effort to maintain backup integrity and availability
⚠️ CRITICAL: No Backup Guarantee - Your Responsibility
IMPORTANT DISCLAIMER: While we provide daily backups as a courtesy, WE DO NOT GUARANTEE THE AVAILABILITY, COMPLETENESS, ACCURACY, OR SUCCESSFUL RESTORATION OF ANY BACKUP DATA. Backups are provided "AS IS" without any warranty whatsoever.
Limitations & Exclusions
You must understand and accept the following limitations:
- No Liability for Backup Failures: GK Host Point, AquaHost, and HostingMaster are NOT responsible for any backup failures, corruption, or unavailability
- Technical Crises: In the event of server crashes, hardware failures, network outages, data center disasters, or any other technical emergencies, we are NOT liable for data loss
- Best Effort Only: While we make every reasonable effort to keep your data safe and restore backups when requested, success is NOT guaranteed
- No Guaranteed Recovery: There may be circumstances where backup restoration is impossible due to corruption, hardware failure, or other technical issues beyond our control
- Limited Retention: Backups older than 3 days are automatically deleted and cannot be recovered
- Not a Disaster Recovery Service: Our backup service is a courtesy feature, not a professional disaster recovery or business continuity solution
Your Legal Responsibility
YOU ARE SOLELY AND COMPLETELY RESPONSIBLE FOR MAINTAINING YOUR OWN INDEPENDENT BACKUPS. This means:
- You must create and maintain your own backup copies of all website files, databases, emails, and other critical data
- You should download and store backups on your local computer or separate cloud storage services (Google Drive, Dropbox, etc.)
- You should perform regular backups according to your business needs and data sensitivity
- You accept full responsibility for any data loss, regardless of the cause
- You acknowledge that relying solely on our courtesy backups is at your own risk
Scenarios Where We Are NOT Liable
GK Host Point, AquaHost, and HostingMaster are expressly NOT responsible for data loss in the following situations:
- Server Hardware Failure: Hard drive crashes, RAID failures, or other hardware malfunctions
- Data Center Disasters: Fire, flood, earthquake, power outages, or natural disasters affecting our facilities
- Cyber Attacks: Hacking, ransomware, DDoS attacks, or other malicious activities
- Software Failures: Backup software bugs, corruption, or technical glitches
- Human Error: Accidental deletion by our staff or automated processes
- Network Issues: Internet outages, bandwidth problems, or connectivity failures
- Account Termination: Data deletion following account suspension or termination for policy violations
- Service Cancellation: Data is permanently deleted after 7 days of account closure
Recommended Best Practices
We strongly recommend implementing the following backup strategies:
- 3-2-1 Backup Rule: Keep 3 copies of your data, on 2 different storage types, with 1 copy stored offsite
- Multiple Backup Locations: Store backups on your local computer, external hard drive, and cloud storage
- Regular Downloads: Download backups from your cPanel weekly or monthly depending on update frequency
- Automated Backup Tools: Use WordPress plugins (UpdraftPlus, BackupBuddy) or third-party backup services
- Test Your Backups: Periodically verify that your backups can be successfully restored
- Critical Data Priority: Ensure your most important business data is backed up immediately after changes
Premium Backup Solutions (Optional)
For users who require enhanced backup security and longer retention periods, we offer paid backup solutions:
- Google Drive Backups: Automated backups to your personal Google Drive account with extended retention
- SFTP Remote Backups: Store backups on your own remote SFTP server for complete control
- Extended Retention: Keep backups for 7, 14, or 30 days based on your needs
- Priority Restoration: Faster backup restoration with dedicated support

BY USING OUR SERVICES, YOU EXPLICITLY ACKNOWLEDGE AND AGREE THAT:

2. You accept complete responsibility for maintaining your own independent backups
3. You will not hold GK Host Point, AquaHost, or HostingMaster liable for any data loss, regardless of cause
4. You understand that our courtesy backup service is provided without any guarantees
5. You accept all risks associated with data loss and will not seek compensation from us
IF YOU CANNOT AFFORD TO LOSE YOUR DATA, YOU MUST MAINTAIN YOUR OWN BACKUPS. NO EXCEPTIONS.

Prohibited Uses
The following activities and content are strictly prohibited on our servers:
- Illegal Content: Hosting any illegal content, pirated software, or copyrighted material without proper authorization
- Adult Content: Pornographic or adult content (as per Indian laws)
- Spam & Bulk Email: Sending unsolicited emails, spam, or mass marketing messages
- DDoS Attacks: Launching or participating in denial-of-service attacks or network flooding
- Hacking Tools: Hosting hacking tools, exploits, or malicious scripts
- Resource Abuse: Running resource-intensive applications without prior approval (mining, heavy scripts)
- Phishing Sites: Creating phishing pages or fraudulent websites
- Proxy/VPN Services: Operating proxy or VPN services without authorization
- Malware Distribution: Hosting or distributing viruses, trojans, or malicious software
- Illegal Activities: Any activity that violates Indian laws or regulations
Consequences: Violation of these terms will result in immediate account suspension or termination without refund.

Service Level Agreement (SLA)
We guarantee the following service levels:
- Uptime Guarantee: 99.9% network uptime (excluding scheduled maintenance)
- Scheduled Maintenance: Planned maintenance will be announced 48 hours in advance
- Support Response: Email/ticket support responds within 24 hours during business hours (Mon-Sat, 10 AM - 7 PM IST)
- No 24/7 Support: We do not provide round-the-clock phone or live chat support
- Server Monitoring: 24/7 automated monitoring for server health and performance

Account Termination
We reserve the right to terminate accounts under the following circumstances:
- Violation of any terms outlined in this agreement
- Non-payment or payment disputes
- Fraudulent activity or false information
- Excessive resource usage affecting server performance
- Abuse reports or legal complaints
- Hosting prohibited content or engaging in illegal activities
Upon termination, all services will be suspended immediately and data may be deleted after 7 days.

Limitation of Liability
By using our services, you acknowledge and agree that:
- GK Host Point is not liable for any data loss, downtime, or service interruptions
- Services are provided "as is" without warranties of any kind
- Our maximum liability is limited to the amount paid for services in the last 12 months
- We are not responsible for third-party services, software, or applications
- You are responsible for maintaining your own backups and security measures
